Cloud Study (the “Operator”) establishes this Privacy Policy (the “Policy”) regarding the handling of users’ personal information in connection with the services provided on this website (the “Service”).
1. Personal Information
(1) “Personal Information” means personal information as defined under the Act on the Protection of Personal Information of Japan. It includes information relating to a living individual that can identify that individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in the information, as well as personal-identification information that can identify an individual by itself, including facial, fingerprint, and voiceprint data and identifiers such as a health-insurance insurer number.
2. How We Collect Personal Information
(1) When a user registers for the Service, the Operator may request personal information such as the user’s name, date of birth, address, telephone number, email address, bank account number, credit card number, or driver’s license number. The Operator may also collect records of transactions and payment-related information containing the user’s personal information from business partners, including information providers, advertisers, and advertising distributors (collectively, “Partners”).
3. Purposes of Collecting and Using Personal Information
(1) The Operator collects and uses personal information for the following purposes:
• To provide and operate the Service
• To respond to user inquiries, including identity verification
• To send emails about new features, updates, campaigns, and other services provided by the Operator
• To provide maintenance notices, important announcements, and other necessary communications
• To identify users who violate the Terms of Service or attempt to use the Service for fraudulent or improper purposes, and to deny their use of the Service
• To allow users to view, modify, or delete their registration information and view their usage status
• To bill users for paid services
• For purposes incidental to the purposes listed above
4. Changes to the Purposes of Use
(1) The Operator may change a purpose of use only when the changed purpose is reasonably related to the original purpose.
(2) When a purpose of use is changed, the Operator will notify users of the revised purpose by a method prescribed by the Operator or publish it on this website.
5. Provision of Personal Information to Third Parties
(1) Except as permitted by the Act on the Protection of Personal Information or other applicable laws, the Operator will not provide Personal Information to a third party without the user’s prior consent, except in the following circumstances:
• When necessary to protect a person’s life, body, or property and obtaining the individual’s consent is difficult
• When particularly necessary to improve public health or promote the sound development of children and obtaining the individual’s consent is difficult
• When cooperation is necessary for a national government agency, local government, or a party entrusted by either to perform duties prescribed by law, and obtaining consent may impede the performance of those duties
• When the Operator has notified or publicly announced the required matters in advance and has submitted the required notification to the Personal Information Protection Commission, including the purpose of third-party provision, the data items provided, the method of provision, the suspension of provision upon request, and the method for receiving such requests
(2) Notwithstanding the preceding paragraph, a recipient will not be regarded as a third party in the following cases:
• When the Operator outsources all or part of the handling of Personal Information to the extent necessary to achieve a purpose of use
• When Personal Information is provided in connection with a business succession resulting from a merger or other reason
• When Personal Information is jointly used with a specified party and the legally required information regarding the joint use has been provided to the individual in advance or made readily accessible
6. Disclosure of Personal Information
(1) When an individual requests disclosure of their Personal Information, the Operator will disclose it without undue delay. However, the Operator may withhold all or part of the information if disclosure could harm the life, body, property, or other rights or interests of the individual or a third party; materially interfere with the proper operation of the Operator’s business; or violate a law. If disclosure is withheld, the Operator will notify the individual without undue delay. A fee of JPY 1,000 will be charged for each disclosure request.
(2) As a general rule, information that does not constitute Personal Information, such as history and attribute information, will not be disclosed.
7. Correction and Deletion of Personal Information
(1) If Personal Information held by the Operator is inaccurate, a user may request its correction, addition, or deletion (collectively, “Correction”) in accordance with procedures established by the Operator.
(2) If the Operator determines that it is necessary to comply with the request, it will carry out the Correction without undue delay.
(3) The Operator will notify the user without undue delay when it has carried out the Correction or decided not to do so.
8. Suspension of Use
(1) If an individual requests the suspension or deletion of the use of Personal Information (collectively, “Suspension of Use”) on the grounds that it is being handled beyond the scope of its stated purposes or was acquired by improper means, the Operator will conduct the necessary investigation without undue delay.
(2) If the Operator determines based on the investigation that it is necessary to comply with the request, it will carry out the Suspension of Use without undue delay.
(3) The Operator will notify the individual without undue delay when it has carried out the Suspension of Use or decided not to do so.
(4) If Suspension of Use would involve excessive cost or is otherwise difficult, the Operator may take an alternative measure necessary to protect the individual’s rights and interests.
9. Changes to This Privacy Policy
(1) Except for matters otherwise provided by law or this Policy, the Operator may change this Policy without prior notice to users.
(2) Unless otherwise specified by the Operator, a revised Privacy Policy takes effect when posted on this website.
